A pesquisa
pesquisa bibliográfica, documental e análise do caso concreto.

ABSTRACT: This paper analyzes the civil liability of the State in cases of death of
adolescents subjected to socio-educational detention measures, focusing on a case
study that occurred at the Male Adolescent Detention Center (CIAM), in the
municipality of Marabá, located in the state of Pará. The research stems from the problem related to the State's duty to guard and protect adolescents deprived of liberty
and the accountability of the public authorities in the face of failure to provide the
service. The general objective is to examine the legal foundations of State civil liability
in situations involving violations of the physical integrity and life of adolescents
detained in socio-educational units. As specific objectives, it seeks to analyze the
comprehensive protection provided for in the Federal Constitution, the Statute of the
Child and Adolescent (ECA), and the National System of Socio-educational Care
(SINASE), as well as to verify the jurisprudential understanding of the matter. The
methodology used is based on bibliographic and documentary research and analysis
of the specific case. The results demonstrate that the State has objective responsibility
for preserving the physical integrity of adolescents under its custody, being liable for
damages resulting from the omission in the duty of vigilance and protection within the
detention units. It is concluded that the realization of the fundamental rights of detained
adolescents depends on the strengthening of socio-educational public policies and the
guarantee of adequate conditions of security and dignity in the detention system.
